EB-5 Minimum Requirements

The EB5 visa provides a path for immigrant investors to obtain lawful permanent residency by investing at least $900,000 in a "targeted" area or $1,300,000 in a non-targeted area (please be aware that these minimums were raised from $500,000 and $1,000,000 respectively on Nov. 21, 2019).

The advantages of an EB-5 visa:

  • The EB-5 Visa Program is a direct path for foreign nationals to obtain a U.S. “Green Card” [legal permanent residency or LPR] by making a qualifying investment in a business located in the United States
  • Green Cards obtained through the EB-5 Visa Program provide permanent residency for the applicant, for their spouse and for any children they have under the age of 21
  • The EB-5 Visa path avoids the usual requirements of having family connections (a sponsoring family member that is already a US citizen), securing a job offer as in the H1b visa program, or running an actively trading business as in the L1 intracompany transfer or EB2 treaty trader visas.
  • As noted above, under the new requirements applicants must invest at least $900,000 in a business that creates or saves 10 or more jobs, and keeps this investment for at least five years.
  • After five years of holding the Green Card you can apply for naturalization (full US citizenship).
  • While in possession of the EB-5 visa and Green Card, you may live and work anywhere you wish in the US.
  • Family-based visa petitions and H1b "tech worker" visas often have significant backlogs and delays. There is no backlog for EB-5 visas at the present time, except for applicants from the People's Republic of China.
